TRANSPORTED SEMEN BREEDING AGREEMENT

This certifies that the mare owner listed above has engaged to breed the mare named above to THE JOY OF MONEY for a fee of $750.00. This agreement is subject to the following conditions:

• Payment of $250.00, which shall serve as a booking fee and is non-refundable, along with a signed copy of this contract must be received prior to shipment of transported semen..
• A schedule of other possible charges is attached to this contract and made a part thereof.
• It is the mare owner's responsibility to call in advance of the planned breeding date to check the collection and shipping schedules. Normal collection days are Monday, Wednesday, Friday and Saturday. Your request for semen needs to be telephoned no later than 10:00 AM Central Time on your scheduled collection day to meet shipping deadlines.
• The shipping container (Equitainer) will be furnished by Chism Trail Farm. All shipping charges will be paid by the mare owner and must be paid prior to the shipment of semen. The mare owner agrees to return the Equitainer to Chism Trail Farm by Two Day return shipping service. If the Equitainer is not returned promptly, there will be no further shipment of semen. Failure to return the Equitainer within ten (10) days will result in a $100.00 penalty plus the cost of replacing the container. The cost of replacing the container is approximately $250.00. We recommend that the mare owner insure the container for this amount when returning the container. If the container is not returned within two (2) days of receipt, a charge of $5.00 per day will be assessed.
• Each shipment will contain one or two insemination doses at the discretion of the stallion manager.
• Chism Trail Farm only assumes responsibility to ship semen in a viable condition at the time of delivery to the mare owner's farm or other designated location. Chism Trail Farm assumes no responsibility for the loss of semen viability or associated expenses due to any delay in airline schedules, or delay in courier services beyond our control. The semen must be administered by a licensed veterinarian or an authorized technician on the day of delivery or return privileges shall be null and void.
• Should the mare fail to produce a foal which stands and nurses, the mare owner shall be entitled to rebreed the mare or a substitute mare for a period of two (2) years from the date of first service. It is the responsibility of the mare owner to notify Chism Trail Farm in writing by certified mail, attested by a veterinarian, within ten (10) days of the determination. There will be no additional breeding fee for a rebreed, but all other transported semen fees shall apply. Failure to notify Chism Trail Farm in a timely manner shall result in the loss of return privileges. This clause is also binding in the case of an abortion.
• All mares must receive first service within eighteen (18) months of execution of this contract. If the stallion is unavailable for breeding for any reason the contract term is extended for that period of time.
• Mare owner agrees to have the mare pregnancy checked by a licensed veterinarian within 45 days after the last breeding date. Rebreed privileges shall become null and void if the mare is not checked within 45 days of the last breeding date and the stallion manager notified of the results.
• Mare owner agrees to keep said mare in good physical condition throughout her pregnancy, vaccinate for Rhino pneumonitis at 5, 7, and 9 months of pregnancy and to deworm regularly. If these normal health care practices are not performed, all guarantees and return privileges shall be null and void.
• The mare owner fully understands, authorizes and assumes the special risk inherent in breeding with the use of transported semen. Mare owner also understands the risk of failure due to many variables and shall hold Chism Trail Farm harmless for any losses suffered due to an unsuccessful attempt at conception.
• The balance of the stud fee in the amount of $500.00 is due when the mare is declared in foal. 
• A service charge of 1.5% per month will be applied on all open accounts more than 30 days past due. In the case of default on payment of this account, mare owner agrees to pay collection costs and reasonable attorney fees incurred in the attempt to collect this amount.
• Foal registration papers and breeding certificates will not be furnished until the mare owner's account is in good standing with both the stallion manager and the stallion owner.
• This stallion service contract for breeding by transported semen may not be assigned or transferred to another person or another mare without the express written consent of Chism Trail Farm. Any attempt to obtain a pregnancy with the transported semen in any mare other than the mare described in this contract without the express, written consent of Chism Trail Farm shall result in a forfeiture of all breeding fees and the right to a signed registration certificate for the resulting foal.
• In the event of THE JOY OF MONEY's death, his becoming unfit for service, or his being sold, the mare owner, stallion owner and Chism Trail Farm shall be released from this agreement, thereby making it null and void.
• This agreement has been made and shall be construed and enforced under the laws of the State of Tennessee with respect to any and all matters arising out of this agreement. This agreement shall not be binding unless it has been received by and signed on its behalf by a duly authorized officer or agent of Chism Trail Farm.
